1. SPECIFICATION
1.1. The Colourshade Z25, Colourshade eXtreme 32 and DriZ Waterproof fabrics, hereto referred collectively as ‘the netting’, is manufactured from High Density Polyethylene raw materials. During the extrusion of the yarns (and waterproof lamination for the DriZ fabric), colour concentrates and ultra-violet stabilisation additives, as recommended by Ciba Speciality Chemicals (Pty) Ltd., are added to the raw materials, thus enhancing the life of the netting against degradation from exposure to sunlight.
1.2. The shade percentage specified in the netting is measured in accordance to the South African Bureau of Standards Light Transmittance Test Method, SABS 1150, and will not vary by more than 5% above or below the specified percentage.
2. PERFORMANCE
2.1. The netting is designed to filter sunlight for the purpose of controlling the exposure of assets, people, animals, crops and plants to the sun; and with regard to the DriZ fabric also designed to prevent rain water from permeating it.
2.2. With the exposure to the sun, the netting, in common with all Polyethylene products, will degrade over a period of time. Contact with certain chemicals, which may be used to treat timber and/or metal structures, or contained in certain fertilisers and pesticides, may also cause or accelerate the fabric to deteriorate or suffer damage.
2.3. Despite using high quality light fastness and heat stable colour concentrates, there will, over a period of time be colour fading or colour deterioration.
2.4. Depending on location, UV intensity of the sun, moisture and cloud cover, some colours will be more prone to colour fading than others.
2.5. Fading is the process of a gradual loss of colour which starts immediately when the products are exposed to sunlight. The rate at which this takes place is dependent on the conditions as noted in Section 2.4 above.
3. WARRANTY
3.1 Warranty – Colourshade Z25 and eXtreme 32 Fabrics
The Colourshade Z25 and eXtreme 32 fabrics carry a 10 (ten) year limited warranty from the date of supply. This warranty warrants that the netting will not fail as a result of disintegration as a consequence of exposure to the sun, during the 10 (ten) year period. Should the netting fail due to degradation caused by the sun during the period of this warranty, the company will replace the affected netting at a price based on the original selling price at the time of purchase, discounted by 10% per annum in respect of the period from the date of failure to the expiry of the period of this warranty.
3.2 Warranty – DriZ Waterproof Fabric
The DriZ Waterproof fabric carries a 5 (five) year limited warranty from the date of supply. This warranty warrants that the netting will not fail as a result of disintegration as a consequence of exposure to the sun, during the 5 (five) year period. Should the netting fail due to degradation caused by the sun during the period of this warranty, the company will replace the affected netting at a price based on the original selling price at the time of purchase, discounted by 20% per annum in respect of the period from the date of failure to the expiry of the period of this warranty.
4. LIMITATIONS AND EXCLUSIONS
4.1. This warranty does not cover, nor will the company be liable for any failure of, or damage to the netting as a consequence of, but not limited to, the following:
4.1.1. Damage to the netting caused by abrasion or other mechanical means, including damage which may occur during ‘take down’ and/or ‘re-erection’ by a non-authorised company installer.
4.1.2. Damage to or failure of the netting caused by contact with chemicals.
4.1.3. Damage to or failure of the netting caused by Acts of God, misuse, neglect, accidents, or attempted repair by a non-authorised company installer.
4.1.4. Damage to or failure of any modifications, additions, or attachments made without prior written consent of the company.
4.1.5. Colour fading.
4.2. The Company’s liability is limited to the replacement of the affected netting on the basis set out in Section 3 above. Under no circumstances will the company be liable for any consequential or indirect loss including damage to crops, plants, equipment or other assets, nor for any costs incurred in replacing the affected netting, including delivery and erection costs.
4.3. Under no circumstances will the company be liable for products not manufactured by the company, such as sewing yarns etc.
4.4. Recommendations on the use of various shade fabrics and shade factors are given in good faith. However, no liability for crop failure/damage of any kind, or damage to property and assets, will be entertained by the Company.
5. CONDITIONS
This warranty is the only warranty given by the company and any warranty that may otherwise be implied in law is hereby excluded.
Anyone wishing to claim under this warranty must:
5.1. Furnish the company with documentary proof of purchase of the netting, including the purchase price paid and provide the company with samples of the damaged netting.
5.2. Allow the company’s staff to view the affected netting in situ.
5.3. Allow the netting to be tested by the appropriate specialists, with whom the company considers necessary.
